Should You Contact a Fertility Lawyer Before Treatment Begins?

Not every fertility treatment requires an attorney. If third-party reproduction is involved, however, speaking with a lawyer earlier can help you understand issues involving agreements, parentage, and the legal structure of the arrangement.

This can be particularly helpful if you are still deciding between donor or surrogacy options or have questions about how your marital status, genetic relationship to the child, or other circumstances may affect the legal process.

When Should You Contact a Lawyer About an Egg or Sperm Donor?

Once you have matched with a donor, the legal process generally needs to be completed before the clinic provides legal clearance and moves ahead with the applicable treatment.

Florida law provides that an egg or sperm donor generally relinquishes parental rights and obligations relating to the donation, subject to statutory exceptions. An attorney can prepare or review the donor agreement, address the parties’ rights and responsibilities, coordinate with separate counsel when applicable, and complete the legal documentation needed for the next stage.

When Should You Contact a Lawyer About Surrogacy?

Ideally, before the embryo transfer or other medical steps associated with the surrogacy begin.

Florida has specific statutory requirements for gestational surrogacy agreements. Under Section 742.15, a qualifying gestational surrogacy contract must be entered into before the parties engage in gestational surrogacy, and the statute identifies terms that the contract must contain.

Florida also has different legal pathways for arrangements that do not fit within that statute, including certain preplanned adoption arrangements. That is why the legal structure should be identified before treatment moves too far forward.

Does the Fertility Lawyer Stay Involved During Pregnancy?

In surrogacy matters, the legal work may continue through pregnancy and birth. Depending on the arrangement, the attorney can prepare the necessary parentage and court documents so the legal process is ready to proceed at the appropriate time.

For gestational surrogacy governed by Section 742.15, Florida law provides a specific expedited parentage procedure after birth, including a petition for affirmation of parental status within three days after the child is born.
